Liability Waivers and Toddler Birthday Parties - Toddlers - Families ...

birthday If your toddler participates in any organized activity, such as day care or baby fun activity centers, you are probably used to signing a waiver before your child can participate. After all, minor bumps and bruises can be a part of a child's life, and most healthy toddlers have a banged knee at one point or another.

But what if you have to sign a liability waiver just for your toddler to attend a friend's birthday party in someone's home? You have to agree to hold the host family harmless if something should happen to your little one.

Why a liability waiver? Will the party include live lions or toddler-eating snakes. The idea of liability waivers and toddlers makes me picture a hostile living room where the birthday balloons are filled with poison gas and the toddlers have to navigate barbed wire just to get to the birthday cake.

Unfortunately, many "normal" families are now including liability waivers in with their birthday party invitations. It can turn a fun and friendly interaction to a legal contract that is just, well, weird.

So how do you react if you get one and don't want to sign it? Perhaps ask the host if there are specific dangers that the family is concerned about. Maybe there is a pool in the home or peanuts being served. Whatever the case, toddlers shouldn't be left alone unsupervised at any birthday party anyway. Parents should be welcome and encouraged to stay for as long as their child will be there. Ultimately, parents should be responsible for their own children anyway.

If you are presented with a liability waiver for a home-based birthday party, you don't have to sign it of course. I would imagine that most hosts would back down. If not, you might want to introduce your toddler to some new little friends.

Make the most of your outlet store shopping

Thrift stores are the cheapest places to buy clothes, but selection can be limited.? Next stop: consignment and outlet stores.

While thrift stores and secondhand stores are my first line of defense when it comes to new clothes, I don?t always find what I need there. I?m very tall with a long upper torso, which means that a lot of shirts just don?t fit me well. They?re either cut for someone who weighs a lot more than I do or they simply aren?t long enough to the point that they reveal my lower back when I?m just standing normally. Neither of these things are really acceptable, so I have to be fairly careful when buying clothes.

There are similar sizing issues for our children. They each have my relatively long torso, which means that children?s sizes sometimes fit them well and sometimes do not. As is the case with me, we have to be a little selective in the clothes we buy them lest they look comically baggy or too short.

If we?ve had a dry run with Goodwill and other highly discounted secondhand shops, we?ll often move up to the next level, which is a little more expensive but adds a lot of options: consignment shops and outlet stores. We use consignment shops and outlet stores primarily as a follow up to stores like Goodwill. In general, prices are higher at consignment and outlet stores than at Goodwill, but it?s easier to find items that match what you?re looking for.

Let?s clarify what exactly we?re talking about here first. Outlet stores typically are an outlet for a particular clothing factory or clothing brand. Usually (and I?ll discuss this more below), they sell slightly flawed versions of normal items ? something isn?t stitched right, something has a minor flaw, something has a hole, or something else like that. Because of that flaw, they can?t sell it at normal price, but the flaw isn?t bad enough to make it unusable, and that?s what an outlet store is for. They?ll sell items with minor flaws that are otherwise normal for a discount price.

Consignment shops are typically where high-quality used items are sold on a per-item basis. Usually, someone has a nice wardrobe, takes it to a consignment shop, and the consignment shop picks which items they think will sell. The sale price of the item is split between the shop and the person who contributed the item.

Here are a few tips.

For starters, some outlet stores have the same prices as normal stores ? they just put the word ?outlet? on the sign to get customers in the door. Sarah and I experienced this firsthand very recently when we visited an outlet center only to discover that most of the stores in the outlet center were barely discounting their prices and seemed to be selling the usual things that would be sold in one of that brand?s normal stores.

Don?t simply trust that a store has bargains just because it says ?outlet? on the window. Come equipped with a sense of what the items should actually cost (and don?t be afraid to use any mobile devices you might have to check). If the prices aren?t a bargain, don?t buy.

Consignment shops are generally a good place to look for nicer, dressier clothes. My general experience has been that consignment stores generally don?t bother with items that aren?t pretty nice, though the policies tend to vary from consignment shop to consignment shop. I?ll utilize these as part of my search if I?m looking for nicer clothes for special occasions, but for ordinary wear, I rarely find good items in consignment shops.

In other words, if you?re trying to find a good price on a great dress or a suit, a consignment shop that sells clothing would be a good place to look for a bargain, though, as I mentioned above, consignment policies do vary.

As always, be selective. Just because something is on sale or has a really low price does not mean you have to buy it. Never shop for clothes unless you have a genuine need for clothes or see that need coming in the near future.

For us, consignment shops and true outlet stores are a great place to look for clothes if other resources (clothes swaps, Goodwill, and so on) don?t pan out. The prices are still usually very good for what you find and you?ll often come home with some quality items.

Genentech, ImmunoGen 'Smart Bomb' for Breast Cancer Clears Big ...

Genentech has been saying for years that it has confidence in a?supercharged version of its hit breast cancer drug, and today it cleared a?major hurdle on the way to making it?a?reality.

The South San Francisco-based company, a?unit of Roche, said today that trastuzumab emtansince (T-DM1) passed its biggest clinical trial yet, a?study of 991 women with metastatic breast cancer that overexpresses the HER2 protein, and who have previously been treated with the original trastuzumab (Herceptin) and a?taxane chemotherapy. The trial, called Emilia, randomly assigned women to get either T-DM1 or a?combination of GlaxoSmithKline?s lapatinib (Tykerb) and a?chemo drug called capecitabine (Xeloda).

Full details weren?t released today, but Genentech said its new drug met the study?s goal, keeping tumors from spreading for a?significantly longer time than the drugs in the control group. Safety results were consistent with what was seen in prior studies, the company said. Even though the company hasn?t yet followed patients long enough to see if the new drug can extend lives, Genentech said the data was compelling enough for the company to file an application seeking FDA approval of T-DM1 this year, and Roche plans to do the same in Europe. About 229,000 women in the U.S. are diagnosed with breast cancer each year, and the new drug, if approved, could be a?potent new option for about one-fourth of patients whose tumors overexpress the HER2?protein.

?While prior data clearly showed the efficacy and safety of T-DM1 in both first and third line breast cancer, no data was previously available to directly compare the efficacy of T-DM1 to Tykerb/Xeloda,? said Jason Kantor, an analyst with RBC Capital Markets, in a?note to clients today. ?While we believe most investors assume EMILIA would be positive, for us, the results are an important derisking?event.?

T-DM1 is interesting not only for breast cancer patients, but for scientists, because of its unusual way of attacking cancer cells. Genentech has had huge success over the years with its original antibody, trastuzumab (Herceptin), which precisely targets the HER2 protein. But scientists there, along with collaborators at Waltham, MA-based ImmunoGen, believed they could give the drug even more tumor-killing punch if they could attach a?potent toxin to the antibody, making it sort of like a?heat-seeking missile.

Genentech previously sought FDA approval on a?smaller body of evidence from mid-stage clinical trials, and was turned down in August 2010. Since then, Genentech has beefed up the body of evidence for the drug, showing T-DM1 beat its own original product in a?head-to-head study of 137 patients, in addition to the results from today?s bigger Emilia study. And the company isn?t stopping there, running two more Phase III clinical trials of T-DM1 in a?couple different?settings.

Even though Genentech is responsible for development, and will keep the vast majority of product revenues for itself, today?s result is an important moment for ImmunoGen. The company stands to collect a ?mid-single digit? percentage royalty on worldwide sales from T-DM1, because of its contribution to help link the antibody to the toxin. ImmunoGen has no products of its own on the market, and the approval of T-DM1 would provide a?significant percentage from a?potential multi-billion dollar?seller.

Shares of ImmunoGen (NASDAQ: IMGN) climbed 9?percent to $15 at 10:19 am Eastern?time.

The importance of retirement communities is something that should never be overlooked. After all, retiring is something that should always be done in style, yet many people don't take this into consideration until it is perhaps a bit too late. In order to retire in a way that suits your lifestyle, you'll want to consider every different option that you have in front of you. Retirement communities are ideal for those who are looking to retire comfortably, and should always be considered the best option for retirement. The following are a few ideas as to why you might want to consider retirement communities.

Is It WRONG To Put A Seven-Year-Old Girl On a Weight Loss ...

Yes? Well, not so fast?..

For many mothers, this topic may fall into a ?damned if you do, damned if you don?t? category.

In the latest issue of Vogue Magazine, a controversial article written by one New York mom has the blog sites, news commentators, and general public up in arms about Dara-Lynn Weiss? efforts to bring her 7 year old daughter Bea?s weight under control. The article has been met with scathing commentary from many people-who have ?suggested that Mrs. Weiss be pilloried in the town square or at the very least be nominated ?Worst Mom in the History of Planet Earth.?

But wait a minute???

What did this mom do? I am going to sum up the critical points but I highly suggest that before you judge Mrs. Weiss, you read the complete article. Here?s the deal:

This mom had seen her daughter?s weight slowly creep up over the years and did nothing to address it. She basically hoped her child would ?grow out of it? or that the problem would correct itself somehow. Mrs. Weiss freely admits that she has always had problems with weight, been on every diet imaginable, and knew what a struggle it was to lose weight?and she didn?t want to put her daughter through what she thought would be a painful process. Finally, at an annual checkup, little Bea?s doctor stated that Bea was clinically obese and that something MUST be done about her weight.?So, what do you DO when you must help your child do something that you have struggled with your entire life? Mrs. Weiss did alot WRONG, but here is where I disagree with those who are completely bashing/trashing her?she got alot RIGHT. Here?s what I give her credit for:

  • She TOOK ACTION when the doctor told her something needed to be done, instead of taking the tone-deaf reaction of ?my child is perfect the way she is/there is nothing wrong with her weight/being overweight is not unhealthy?
  • She enlisted the help of a professional childrens dietician to lay the foundation of a good eating plan
  • She tried to increase Bea?s physical activity by enrolling her in karate class
  • She tried to enlist the whole family (Bea?s brother that had no weight issue) in the process, by educating him on healthy choices as well and taking him to weigh ins with the doctor.

These are some of the GOOD things that she did and as such, I don?t think that she needs to be run out of town on a rail. Now, here are some of the things she did that I DON?T agree with:

  • She embarrassed her child/made scenes in public situations when it came to eating/choosing the right foods. Embarrassing your child when it comes to eating/weight issues is never okay. The mother?s heart was in the right place (trying to be strong for her daughter in making the right food choice) but she went about this in the wrong way.
  • Making too much of an emphasis on ?good? and ?bad? foods. At seven years old, I don?t think it is necessary to totally demonize certain foods for your child, or to make an issue of ?you can?t have ANY of that? (for example, when schoolmates are having cupcakes to celebrate a birthday). ?I think she should have concentrated more on making sure those types of products were not in the home?where Bea SHOULD be eating the bulk of her meals?and when an occasion comes up at school to have a ?treat?, that Bea was not made to feel different or ?punished? because she was trying to lose weight.
  • Ensuring that your child eats appropriate portions and is not overeating-YES. Making your child go to bed without dinner or not allowing her to eat something when she is truly hungry-NO.

So many people took issue with this mother?s methods (and some of them were down-right cringe inducing) but this article is fascinating on so many levels. The emotional tie that we have to food, diet, and weightloss issues in this country is absolutely astounding. My thought is we need to use articles such as this as opportunities to open up the discussion around health, nutrition, childhood obesity, lifelong stuggles with weight, and why having a conversation about needing to lose weight need not cause someone lifelong self esteem issues or problems with food.

So, my answer is YES, there are situations where children should and must be put on a healthy eating regimen. It is certainly a parent?s responsibility to help their child become healthy- if it is in their power to do so. I do not in any way agree with or endorse all of the methods that Mrs. Weiss used to help her daughter lose 16 pounds?but I truly believe that she was doing the best she could to help her daughter?just like most parents do when given a situation they aren?t fully equipped to deal with. My guess is if we could look into the homes of many Americans, we would see situations that parents handled a certain way, and upon reflection-wished they had handled differently.

(AP) ? Tiger Woods hit so many great shots that he couldn't single one out as the best. Winning was as sweet as ever, even after a PGA Tour drought that stretched over 923 days and 27 tournaments.

The best part about posing with the trophy at Bay Hill?

The conversation was back on golf, his favorite subject.

Just two weeks ago, Woods gingerly climbed into a golf cart and was taken off the golf course at Doral with soreness and swelling in his left Achilles tendon, the same injury that caused him to miss three months and two majors last year.

On Sunday, no one questioned his health. Woods marched to a five-shot victory in the Arnold Palmer Invitational that restored his confidence and gave him momentum going into the Masters two weeks away.

"This was coming," Woods said. "I've been close a number of times, basically since Australia. Just had to stay the course."

Only a month ago, there were concerns that Woods could no longer make the important putts.

He had missed a 5-foot birdie putt on the last hole to lose in the second round at the Match Play Championship. He missed several putts just as close when he crashed out in the final round at Pebble Beach. But there he was at Bay Hill, knocking in two big par putts on the back nine to keep his distance from Graeme McDowell.

"I just never got close to him," McDowell said.

And then there's the book by his ex-swing coach, Hank Haney. "The Big Miss," which goes on sale Tuesday, has been such a sore spot with Woods that he lost his cool with a reporter earlier this month. The book reveals a driven player who is self-centered and rarely satisfied, no big surprise except that it was a side of Woods he tried to keep private for all these years.

Woods added a chapter to his own book Sunday.

He won for the 72nd time on the PGA Tour ? one short of Jack Nicklaus in second place on the career list ? and 84th time worldwide. It was the 16th time he won by at least five shots, and his seventh win at Bay Hill tied the PGA Tour for most wins on a single golf course. Woods owns both marks. He also has won seven times at Firestone.

"I think he really just kind of nailed home his comeback," McDowell said. "Great to have a front-row seat watching maybe the greatest of all time doing what he does best ? winning golf tournaments."

The only thing missing was the host himself.

Palmer's blood pressure increased during the final round from new medications, and he was taken to the hospital about 15 minutes before the tournament ended as a precaution. Alaistair Johnston, vice chairman at IMG and his longtime business manager, said Palmer would be kept overnight. "Nobody is overly concerned," he said.

Woods goes to No. 6 in the world, returning to the top 10 for the first time since May 22.

"Heading home now and I can't stop smiling. Thanks to Otown fans and everyone watching for all the love. Get well soon, Arnie," Woods tweeted about three hours after his win.

On a Bay Hill course that was crisp, fast and dangerous, Woods ran off four birdies on the front nine to build a four-shot lead, then kept his mistakes to a minimum for a 2-under 70.

He quickly stretched his lead to three shots on the opening hole when McDowell, who closed with a 74, caught a buried lie in the bunker and made double bogey. After that, it was vintage Woods.

From 267 yards away in the fairway on the par-5 sixth, Woods hit a 3-iron that climbed over the water and landed softly to just over 15 feet away to secure a birdie. Two holes later, facing a tight pin over the water, he ripped an 8-iron from 182 yards that barely cleared the bank and caught a slope to within 4 feet for birdie.

The lead was four at the turn, and McDowell never got closer than three the rest of the way. Ian Poulter had a 74 and finished alone in third, and while he never looked behind him to see what Woods was doing, he could hear it.

This is a win that will resonate.

"He's always a force to be reckoned with when he's not playing his best golf," Poulter said. "And obviously, he's playing a lot of good golf right now. The shots he's hit, just looking at the highlights, he's got a lot of his game back. And when he starts rolling putts in, he's dangerous. So he's going to be a force for everybody at Augusta."

Woods finished at 13-under 275.

It was the first time Woods had won on the PGA Tour since Sept. 13, 2009, at the BMW Championship. His last win against a full field had been Nov. 15, 2009, at the Australian Masters.

Twelve days later, Woods drove into a fire hydrant outside his home, and it wasn't long before revelations of multiple extramarital affairs that led to divorce and cost him an impeccable marketing image. Woods has won back the support of fans who love to see great golf, though corporate support has been lagging.

Woods downplayed the significance of Sunday, pointing out on more than one occasion that he considers it his second win since the scandal. He counts the Chevron World Challenge last December, when he went birdie-birdie to beat an 18-man field of top-50 players.

But this was significant ? a PGA Tour event with a full field, and a strong field at that. And with a performance so clean that he was never seriously challenged on the back nine.

"I've gotten better, and that's the main thing," Woods said. "I've been close for a number of tournaments now. And it was just a matter of staying the course and staying patient, keeping working on fine-tuning what we're doing. And here we are."

So where does he go?

Next up is the Masters, which looms larger than ever. Woods figures to be a big favorite, along with Rory McIlroy and Phil Mickelson, all of whom have won in the first three months of the season.

"I've won here on a few occasions going into Augusta, which has always been a good feeling," Woods said. "I still have got some work to do, but I'm excited about the things that we have accomplished. It's been very good."

It felt better than that on the 18th hole, when the familiar red shirt was accompanied by a smile that had not been seen in some time at the end of a tournament.

Top-seeded Spartans fall to Cardinals 57-44

PHOENIX (AP) ? Michigan State's guards struggled with Louisville's pressure and the big men had a hard time getting shots to fall.

Everyone had trouble with Gorgui Dieng.

Dieng blocked seven shots and top-seeded Michigan State had more turnovers than field goals in a 57-44 loss to Louisville in the West Regional Thursday night.

"We just missed some shots that we have hit (in the past)," Michigan State coach Tom Izzo said. "But I also thought they disrupted us a little bit and we just didn't have enough guys that could play well."

Michigan State (29-8) started slow and never got going against Louisville's amoebic defense.

The Spartans got shots they wanted and usually make, but couldn't get many to fall against Dieng or anyone else, shooting 28 percent while being outscored 20-14 inside by the leaner Cardinals.

Green had 13 points and 16 rebounds in his final game for Michigan State, which had 16 turnovers and 15 field goals. Brandon Wood added 14 points for the Spartans, who were outscored 17-4 off the bench.

"He was very disruptive," Michigan State's Draymond Green said. "We're not going to back down from anyone. We took it at him. He pulled off some great blocked shots. That's what he does. That's his strength."

The Cardinals (29-9) relied on 3-point shooting in the first half and moved inside in the second to befuddle the Spartans.

Their defense gave Michigan State fits all night.

Instead of trapping like it normally does, Louisville played a bait-and-switch game with the Spartans and Green, their multitalented forward. The idea was to jump out on screens and to make the Spartans work on every possession and, hopefully, wear them out.

It worked, in large part because Dieng was in the back to clean things up.

Tent-pole thin when he arrived at Louisville, the Senegalese center worked hard on his body and his game, developing into the one player the Cardinals had to have on the floor. When he got in foul trouble, Louisville labored, so one of the key parts of coach Rick Pitino's game plan was to make sure the Cardinals protected him.

They did and he protected the rim in return, getting five of his blocked shots in the second half to prevent Michigan State from mounting any kind of rally. The Cardinals move on to the West final Saturday against the winner between Marquette and Florida.

"When we came here, we know (what) we're going to face," said Dieng, who also had five points, nine rebounds and three steals while matching the school record for blocked shots in an NCAA tournament game. "We knew we were going to come to a war. We need to be tougher than them to win this game."

This sweet matchup of top programs featured two of college basketball's best short-preparation coaches.

Pitino has used his speed-the-opponent-up system to reach the Final Four five times, becoming the first coach to lead three different schools to the national semifinals. Once past the NCAA tournament's first week, he's had a knack for guiding his team further along the bracket, going 10-0 in the regional semifinals.

Izzo has spent his 17 years at Michigan State building teams that can handle the rigors of the Big Ten or switch to greyhound mode when the opponent plays fast. He's been as consistent as any coach in the game, leading the Spartans to the Final Four six times, including the 2000 national title, and 10 trips to the regionals round the past 15 years.

Izzo played the right hand the last time these two basketball brains met, taking the Spartans to the 2009 Final Four after they found a way to break Louisville's pressure.

Pitino had something up his sleeve this time.

With Michigan State bogging the game down, the Cardinals struggled early, missing 12 of their first 13 shots. They snapped out of it by hitting 3s.

Russ Smith hit a pair, Jared Swopshire and Chris Smith each dropped one in and, even Dieng ? 0 for 2 in his career previously ? got one to go in.

Swopshire closed it out with a 3 from the corner to put the Cardinals up 23-18 at halftime. Louisville was 7 of 15 from the arc in the half, but got almost nothing inside, hitting 1 of 15 shots from two-point range.

"Our game plan was to cut off the paint," Izzo said. "I thought we did actually a very good job of that. And yet they hit some 3's."

Louisville shifted gears to open the second half, getting two layups and a dunk to keep its cushion. Swopshire followed with an alley-oop to Siva for the point guard's first points, then stole the inbound pass to set up two free throws by Russ Smith that put the Cardinals up 35-25.

Michigan State managed a short run to get within four, but Louisville used its pressure to get a couple of steals and baskets to go up 43-32. Dieng followed with a couple more swats ? one on Keith Appling that sailed into the stands ? to keep the Spartans at arm's length.

"He played an exceptional game," Pitino said.

Good enough to get Louisville into the regional final for the third time in six years, a trip to New Orleans and the Final Four within its sight.

Effective June 1, 2011, the Company transferred these rights to Mr. Sigurd Jorstad, the Chairman of the Board of Directors of the Company, and the President of United Parking Inc., a company controlled and owned by Mr. Jorstad. The transfer of the asset extinguishes an $80,000 loan payable by the Company to NGNT.

Pursuant to an interim agreement dated June 1, 2011, the Company has further loaned $237,000 to Mr.Jorstad and United Parking Inc. over the course of 2011. The loan will bears interest at seven (7) percent per annum, payable in interest only for 2012 and thereafter monthly blended interest and principal of $7,318 for a period of three years commencing January 31, 2013. The loan is secured by a pledge of 5,006,954 common shares of the Company, which is owned by Mr.Jorstad. If the loan is defaulted, the Company's management is empowered to sell the pledge shares to satisfy the loan.

No further loans will be provided to United Parking Inc. or Mr. Jorstad.

There are three important factors when it comes to any fitness program.

First, be consistent. If you workout sporadically, you will not see change, regardless of what you do. Whatever program you choose, you must commit to it to see results.

Secondly, your workouts must be intense. Intensity has an inverse ratio with time. What this means is that if you are able to push yourself extremely hard in a workout, then your workouts don?t need to be very long. However, if you aren?t pushing very hard, you must work out for a long time.

Finally, all workout programs need variety. If you do the same exercise over and over in the same manner, your body will adapt and you will no longer see results. Choosing functional exercises that work many muscle groups at once is the best way to approach this. Which do you think is more beneficial: doing a bicep curl or doing a pull-up, which works many muscles at once? (Answer: the pull-up.) Changing exercises, the amount of weight you use, the amount of repetitions and time you spend working out consistently is the key.

Nutrition is often the most confusing when it comes to health and fitness. Simply put, we should approach nutrition how our ancestors did and the way God intended us to eat. I suggest beginning with three baby steps.

Drink lots of water. I suggest half your bodyweight in ounces. If I weigh 200 pounds, I would drink 100 ounces of water per day.

Secondly, increase the amount of protein in your diet. I have seen clients lose fat, weight and inches by changing this alone. Good sources of proteins are lean meats, fish and poultry.

Finally, cut out as many processed foods as possible. If food can sit on a shelf for six months without going bad, should we really be putting it in our body?

This isn?t rocket science, although some nutritionists and ?experts? would lead you to believe otherwise. Regardless of your goals, if you follow this common sense approach to fitness and nutrition, you will see a huge change in your life and health.

Romney adds to delegate lead in Illinois primary

(AP) ? Former Massachusetts Gov. Mitt Romney added to his lead in the race for delegates Tuesday by winning the Republican presidential primary in Illinois.

Romney won at least 41 delegates in Illinois and former Pennsylvania Sen. Rick Santorum won at least 10. The two rivals were battling for the last three delegates at stake in the primary, but the results were too close to call on election night.

Former House Speaker Newt Gingrich and Texas Rep. Ron Paul were shut out.

Illinois has a unique system of awarding delegates to candidates. The 54 delegates at stake Tuesday were not determined by the statewide vote. Instead, individual delegates were listed on the ballot in each of the state's 18 congressional districts. They were identified by the candidate they support.

Santorum was at a disadvantage because only 44 of his delegates qualified for the ballot.

Romney leads the overall race for delegates with 563, including endorsements from Republican National Committee members who automatically attend the convention and can support any candidate they choose. Santorum has 263 delegates, Gingrich has 135 and Paul has 50.

It will take 1,144 delegates to win the Republican nomination to take on President Barack Obama in the fall.

So far, Romney has won 54 percent of the delegates at stake in primaries and caucuses. That puts him on pace to clinch the nomination in June, but it doesn't leave much room for error.

Santorum has won 27 percent of the primary and caucus delegates at stake so far. He would need to win 74 percent of the remaining delegates to clinch the nomination before the party's national convention in August.

Artist admits to shortcuts in show about Apple

CHICAGO (AP) ? An artist admitted Friday to taking shortcuts in crafting an often harrowing tale about Apple Inc.'s operations in China after the veracity of his one-man theatrical show was challenged by a public radio program that had based a broadcast on his work.

But writer Mike Daisey said he stands by his monologue and called what he does theater, and not journalism.

"It uses a combination of fact, memoir, and dramatic license to tell its story, and I believe it does so with integrity," Daisey said in a statement posted on his website.

Citing what he called "numerous fabrications," Ira Glass, the host of the popular public radio show "This American Life," said he could not vouch for the truth of a Jan. 6 broadcast excerpted from Daisey's critically acclaimed one-man show "The Agony and the Ecstasy of Steve Jobs."

Later Friday, The New York Times said it had removed a questionable paragraph from the online archive of an op-ed piece Daisey wrote for the newspaper in October.

Daisey also twisted the truth about his time in China during an interview with The Associated Press late last year. Paul Colford, a spokesman for the news cooperative, said the AP was reviewing its coverage of Daisey to determine what corrections will be necessary.

In his monologue performance, which currently running at the Public Theater in New York, Daisey describes meeting very young workers who put in very long hours and were forced to do crippling, repetitive motions at factories that make Apple products in China. Some he claimed had been poisoned by a chemical called hexane.

But "This American Life" says a China correspondent for the public radio show "Marketplace" named Rob Schmitz located and interviewed Daisey's Chinese interpreter, who disputed much of the artist's claims.

Daisey, in an interview with Glass broadcast as part of Friday's episode of "The American Life," admitted that he didn't meet any poisoned workers and guessed at the ages of some of the workers he met.

"This American Life" said in its statement that staffers asked Daisey for his interpreter's contact information while fact-checking the story. Daisey replied the cellphone number he had for her didn't work anymore and he had no way to reach her.

"At that point, we should've killed the story," Glass said. "But other things Daisey told us about Apple's operations in China checked out, and we saw no reason to doubt him."

Apple has been rebutting Daisey's allegations for months, to little effect. The Times also wrote an investigative series in January on dangerous working and living conditions for people who make Apple products in China, including explosions inside factories making iPads where four people were killed and 77 were injured.

An Apple spokeswoman declined to comment Friday. Daisey spokesman Philip Rinaldi said Friday his client was "not speaking to anyone about this right now."

The original "This American Life" episode, "Mr. Daisey and the Apple Factory," has become the most popular podcast in the history of "This American Life" with nearly 890,000 downloads.

Daisey also claimed in an interview with AP late last year that he met Chinese workers whose joints in their hands had disintegrated because they were doing the same motion hundreds of thousands of times.

"I know that people in charge know about these things and chose not to address them. And that's hard to swallow when you see the damage it does and you know how little it would take to ameliorate a high degree of human suffering," he said then.

The Times, which published Daisey's op-ed piece following Steve Jobs' death in early October, removed a paragraph from the online version that discussed conditions at Apple's factory in China. The newspaper posted an editor's note warning readers that the section had been removed because "questions have been raised about the truth."

"The rest of the piece is his opinion as a performer and a thinker," said Eileen Murphy, a Times' spokeswoman. "If this were a news story it would be a different situation. It's not. It's an op-ed."

In his original monologue, Daisey splices Jobs career milestones and the transformation of Apple from a David into a Goliath with more personal stories about his own connection to the computer maker.

He has said that when he saw four photos posted online taken by workers at a Chinese factory to test the iPhone but mistakenly not erased, he suddenly realized people, not robots, were putting the sleek devices together.

In interviews and on stage, Daisey has said he traveled to the Chinese industrial zone of Shenzhen and interviewed hundreds of workers from Foxconn Technology Group, the world's largest electronics contract manufacturer, who suffered from their work.

"It's like carpal tunnel on a scale we can scarcely imagine," he said while performing the show in New York in October.

In this weekend's "This American Life," Daisey tells Glass he felt conflicted about presenting things that he knew weren't true. But he said he felt "trapped" and was afraid people would no longer care about the abuses at the factories if he didn't present things in a dramatic way.

"I'm not going to say that I didn't take a few shortcuts in my passion to be heard," he tells Glass.

Daisey has performed the monologue for some 50,000 people from Seattle to Washington, D.C., and it is now at The Public Theater until Sunday. Daisey was expected to take the show on tour, but its future is now in doubt.

In a statement, The Public Theater said the show would be performed in New York as scheduled and stood by what it called "a powerful work of art."

"Mike is an artist, not a journalist," the statement said. "Nevertheless, we wish he had been more precise with us and our audiences about what was and wasn't his personal experience in the piece."
